Le 15 janvier 2025, Avocats Sans Frontières Tunisie a publié sur Facebook un communiqué cosigné par plusieurs organisations, recopié en français ci-dessous.

quand la justice favorise les tyrans et se venge des activistesFace à l’injustice infligée à Sihem Bensedrine, Présidente de l’Instance Vérité et Dignité, victime de harcèlement judiciaire fondé sur des accusations fabriquées dans le but de se venger des figures clés du processus de justice transitionnelle en Tunisie et de réduire au silence les femmes activistes, cette dernière a annoncé aujourd’hui son entrée en grève de la faim, coïncidant avec le 14ème anniversaire de la Révolution pour la liberté et la dignité. Par cet acte, elle dénonce non seulement l’injustice qu’elle subit, mais aussi l’échec des autorités politiques actuelles à instaurer une justice équitable et indépendante. Elle pointe également leur complicité dans la gestion des dossiers des militant·es des droits humains et des victimes, marquée par une politique flagrante d’impunité pour les auteurs des crimes commis sous le régime autoritaire.
Cela fait maintenant plus de 160 jours que Sihem Bensedrine est détenue à la prison de Manouba, tandis que le pouvoir judiciaire persiste à fermer les yeux sur la poursuite des responsables de graves violations, notamment les assassinats, la torture et les disparitions forcées. Pire encore, le système judiciaire s’inscrit dans une logique de vengeance et de représailles ciblant la présidente de l’Instance Vérité et Dignité.
Cette incarcération représente non seulement une atteinte flagrante à sa liberté et à ses droits fondamentaux, mais aussi un acte d’intimidation à l’égard de l’ensemble des militant·es des droits humains et défenseur·es de la justice transitionnelle. Elle s’inscrit dans une tentative manifeste de faire taire les vérités exposées par l’Instance dans son rapport final sur les violations graves et systématiques, tout en consolidant l’impunité des responsables de ces crimes.
Par conséquent, les organisations et associations signataires déclarent ce qui suit :
Leur exigence de la libération immédiate de l’activiste des droits humains Sihem Bensedrine et l’arrêt de cette mascarade judiciaire.
Leur soutien total et inconditionnel à Sihem Bensedrine dans sa grève de la faim, entreprise pour dénoncer l’injustice dont elle est victime, tout en tenant les autorités responsables de sa santé et de son intégrité physique.
Leur affirmation que l’emprisonnement de Sihem Bensedrine constitue une attaque directe contre le processus de justice transitionnelle, perpétuant la politique d’impunité. Pendant ce temps, les autorités actuelles continuent d’ignorer plus de 205 affaires transmises par l’Instance au système judiciaire, impliquant 1 500 individus, dont 1 200 agents affiliés au ministère de l’Intérieur, soupçonnés de graves crimes.
Un rappel aux autorités que l’absence de mise en œuvre des recommandations de l’Instance Vérité et Dignité fragilise davantage les garanties de non-répétition et alimente les conditions de récurrence des violations. Nous exigeons donc que les responsables soient poursuivis et qu’un engagement sincère envers le processus de justice transitionnelle soit réaffirmé.
Un rappel que la détention et les poursuites engagées contre Sihem Bensedrine sont dénuées de tout fondement factuel ou juridique, ne relevant que d’une logique de représailles. Ces poursuites reposent essentiellement sur des déclarations contradictoires émanant d’un ancien membre discrédité de l’Instance Vérité et Dignité, qui avait déjà été renvoyé devant le conseil de discipline.

Sihem Bensedrine enters in hunger strike
when justice favors tyrants and punishes activistsIn response to the injustice faced by Sihem Bensedrine, President of the Truth and Dignity Commission (IVD), who has been subjected to judicial harassment through fabricated charges aimed at retaliating against key figures of Tunisia’s transitional justice process and silencing women activists, the President of the IVD has announced her decision to begin a hunger strike. This action, taken on the 14th anniversary of the Revolution for Freedom and Dignity, is a powerful protest against ongoing injustice, the political authorities’ failure to establish a fair and independent judiciary, and their complicity in perpetuating impunity for perpetrators of crimes during Tunisia’s authoritarian past, particularly in cases involving human rights activists and victims.
Over 160 days have passed since Mrs. Bensedrine was imprisoned in Manouba Prison, as the judiciary continues to disregard accountability and the prosecution of those responsible for grave violations, including killings, torture, and enforced disappearances. Instead, it has pursued a campaign of revenge and retaliation against the President of the Truth and Dignity Commission.
Her imprisonment is not only a blatant violation of her freedom and rights but also a calculated message of intimidation to human rights activists and defenders of transitional justice. This act can largely be considered as an effort to silence the truths uncovered by the Commission in its comprehensive final report on systematic and severe violations, while ensuring that the perpetrators remain shielded from accountability.
In this context, the undersigned organizations express the following:
Their demand for the immediate release of human rights activist Sihem Bensedrine and an end to the ongoing judicial charade.
Their unwavering and unconditional support for Sihem Bensedrine in her hunger strike, undertaken to protest the injustices she faces, while holding all relevant authorities fully accountable for her physical well-being.
Their affirmation that Sihem Bensedrine’s imprisonment constitutes an attack on the transitional justice process, perpetuating the policy of impunity. The current authorities have buried over 205 cases referred by the Commission to the judiciary, implicating 1,500 individuals, including 1,200 affiliated with the Ministry of Interior, in major crimes.
A reminder to the current authorities that neglecting the recommendations of the Truth and Dignity Commission undermines efforts to prevent the recurrence of violations. They stress the urgent need to prosecute those responsible and to ensure non-recurrence through a genuine commitment to transitional justice.
A reminder that her detention and prosecution lack any factual or legal foundation, serving solely as an act of revenge, primarily based on contradictory claims made by a discredited former member of the Truth and Dignity Commission, who had previously been referred to the disciplinary council.

عدالة تنتصر للطغاة وتنتقم من المناضلات رئيسة هيئة الحقيقة والكرامة سهام بن سدرين في اضراب جوع
على اثر المظلمة التي تتعرض لها رئيسة هيئة الحقيقة والكرامة، سهام بن سدرين، من هرسلة قضائية مبنية على تهم كيدية تهدف إلى التشفي من رموز مسار العدالة الانتقالية في تونس والنساء المعارضات، اعلنت رئيسة الهيئة اليوم دخولها في اضراب جوع في ذكرى ثورة الحرية والكرامة احتجاجا على الظلم وعجز السلطة السياسية الحالية على بناء نظام قضائي عادل ومستقل و تواطئه في معالجة قضايا الحقوقيين/ ات والضحايا في ترسيخ فج لسياسة الإفلات من العقاب تجاه من أجرم خلال سنوات الاستبداد
فقد مر أكثر من 160 يوما على اعتقال السيدة بن سدرين خلف قضبان سجن منوبة، في ظل تجاهل السلطة القضائية لمسار مساءلة ومحاسبة المسؤولين عن الانتهاكات الجسيمة المرتكبة والتي شملت القتل والتعذيب والاختفاء القسري وبل وقامت ايضا على التشفي والانتقام من رئيسة هيئة الحقيقة والكرامة ـ
اذ ان سجنها لا يمثل فقط انتهاكا صارخًا لحريتها وحقوقها، بل هو رسالة ترهيب لكل الناشطين/طات في المجال الحقوقي والمدافعين/ات عن العدالة الانتقالية، وهو ما نعتبره محاولة مكشوفة لقبر الحقائق التي كشفت عنها الهيئة في تقريرها الختامي الشامل بخصوص الانتهاكات الجسيمة و الممنهجة المرتكبة ولضمان افلات الجلادين من العقاب ،
وعليه يهم المنظمات والجمعيات الممضية ادناه ان تعبر عن :
مطالبتها باطلاق سراح الحقوقية سهام بن سدرين ووضع حد للمهزلة القائمة ،
مساندتها المطلقة واللامشروطة لرئيسة الهيئة سهام بن سدرين في معركة الامعاء الخاوية التي تخوضها بهدف رفع المظلمة التي تتعرض لها وتحميل مسؤولية سلامتها الجسدية لكل السلط المعنية ،
تاكيدها على ان حرمان السيدة بن سدرين من حريتها يمثل استهدافا لمسار العدالة الانتقالية وتكريسا لسياسة الإفلات من العقاب. اذ ان السلطة الحالية تواصل دفن أكثر من 205 قضية أحالتها الهيئة إلى القضاء، تشمل 1500 شخص، منهم 1200 ينتمون إلى وزارة الداخلية، ممن تورطوا في الجرائم الجسيمة.
تذكير السلطة الحالية بان عدم تنفيذ توصيات هيئة الحقيقة والكرامة، يعزز الضمانات لعودة الانتهاكات. بناءً على ذلك، نطالب بمحاسبة المسؤولين عن الانتهاكات، وضمان عدم تكرارها من خلال التزام حقيقي بمسار العدالة الانتقالية،
تذكيرها بأن احتجازها وتتبعها لا سند واقعي او قانوني له بل هي مطية للتشفي منها ومبنية أساسا على أقوال متضاربة صادرة عن عضوة هيئة الحقيقة والكرامة مجرح فيها واحيلت سابقا على مجلس الـتأديب.
